Terms & Conditions

The terms and conditions stated below are agreed between Smoot’s Kitchen, LLC and the Client once a deposit has been paid and received.

Please refer to your invoice for specific event details.

DEPOSIT: Fifty percent (50%) of the agreement cost is due and demandable at the time of booking, to be deducted from the Total Final Payment, unless other prior arrangements have been made. All deposits are non-refundable. Such deposit will confirm and guarantee the event date and will be deducted from the total final payment, unless other prior arrangements have been made.

FINAL PAYMENT: Unless other arrangements have been made or Caterer has agreed to payment terms proposed by client, final payment will be due and demandable 7 days prior to the event date.

METHOD OF PAYMENT: All payments may be made in the form of credit card through our merchant, Zelle, Cash App, or Venmo.

SERVICE GRATUITY: Event staff gratuity is not included in the Client’s event/function invoice. At the Client’s discretion, gratuity for Smoot’s Kitchen staff working event/function is appreciated and can be given directly to event staff at the close of event/function. You may also contact Caterer before or after event to arrange payment of gratuity in another form.

Final guest count, not subject to reduction, is due seven (7) days prior to the event date. Client will only be charged for the agreed number of guests expected. If there are a significant number of attendees over the guaranteed guest count, the Caterer will charge the Client accordingly and by the discretion of the Caterer. Caterer is not responsible for an insufficient food quantity if there are attendees over the guaranteed guest count.

Children under the age of five (5) are free of charge, unless Client wishes to provide service/seating for them. Children six to twelve (6-12) years of age will be charged at half price on the agreed upon cost per person. Please advise Caterer of significant number of children ages twelve (12) and under in attendance.

The Caterer, at the request of the Client, or the Client may package up all leftovers that are not able to be reused by the Caterer. The Client may take any leftovers provided in disposable aluminum pans. Unless agreed to and provided for in the Catering Invoice, the client is responsible for providing appropriate containers to package leftovers for guests. In accordance with appropriate Health Codes, the Caterer reserves the right to discard any leftover food item, after the agreed upon event timetable, where there is a reasonable risk for food borne illness to occur.

Client assumes the right and responsibility to provide all or part of the bar/beverage supplies and/or service as per venue guidelines and previous agreements with Caterer. Caterer is never liable for any bar/alcohol related incidents when service is being provided by any party other than Smoot’s Kitchen exclusively. Caterer may also provide beverage service or bar support. 

CANCELLATION: Cancellation of the event by the client for any reason, more than seven (7) days in advance from the event date, all prepayments and deposits are eligible to be used as a credit towards an event within a year of the cancelled date. If the event is canceled, within seven (7) days of the event date, all deposits and payments are forfeited in full unless otherwise agreed upon under extreme circumstances. A client cancelling their engagement by telephone must also verify that cancellation in writing (via email or text).

CHANGE OF EVENT DATE/VENUE: Caterer will apply the entire balance of Client’s deposits and prepayments towards another event less the costs of any of the following: loss of deposits for staffing and/or event rentals, billed hours for commercial kitchen rental usage, purchased groceries not able of being utilized, subject to Caterer’s availability. Client will be charged the difference if additional costs are applied.

If specific food items are unavailable due to shortages and/or events booked within seven (7) days of the Client’s event, at the Caterer’s discretion, there will be an alteration to the menu to replace the menu items.

Caterer may provide all or part of the rental items for the event. The Caterer will/may give you an estimated cost/list of rentals for your event. You may change/cancel those items at any time, however, certain items may incur restocking and cancellation fees. If the Caterer is coordinating rentals on behalf of the Client through a rental company directly. This information will be specified in the Catering Invoice. Certain rentals may be provided by the Caterer. Any loss of damage to any rentals will be charged to the Client.
